These Booking Conditions outline the terms under which you enter into an agreement with us for the arrangement and delivery of your travel services. By confirming a booking, you acknowledge that you have read, understood, and agree to be bound by these conditions. Adventure Proud reserves the right to update or amend these Booking Conditions at any time prior to receiving your booking request.
In these Booking Conditions, “you” and “your” refer to all travellers listed on a booking (including any persons added or substituted at a later date). “We,” “us,” “our,” and “Adventure Proud” refer to Adventure Journeys Group Pty Ltd t/as Adventure Proud.
BOOKINGS
A contract between you and Adventure Proud is created once we issue a written booking confirmation and you have paid the required deposit. We reserve the right to decline any booking at our discretion. Only senior management has the authority to amend or waive these Booking Conditions, or to offer any discount, refund, or credit.
OUR SERVICES
Our services begin as soon as we accept your booking. This includes the substantial work undertaken before travel to coordinate and confirm arrangements. The services provided by Adventure Proud are limited to:
(a) the arrangement and coordination of your travel arrangements; and
(b) the delivery of travel arrangements directly controlled, operated, or owned by us.
PRICES, VARIATIONS & PAYMENTS
Prices
All prices are stated in Australian Dollars ($AUD) and are correct at the time of publication. The latest pricing is always available on our website. Prices include accommodation, transportation, and other inclusions as detailed in the published itinerary.
International and domestic airfares, airport/hotel transfers, passports, visas, vaccinations, insurance, meals (other than those stipulated), emergency evacuation costs, and items of a personal nature are not included unless otherwise specified.
Price Variations
We may apply a surcharge to your booked travel arrangements prior to departure if external factors beyond our control increase costs. These may include, but are not limited to: fuel surcharges, airfare surcharges, government taxes or levies, airline schedule changes, or if minimum passenger requirements are not met.
We also reserve the right to adjust pricing due to currency fluctuations. Once full payment has been received, we will not vary the cost due to exchange rates, and we will absorb the first 2% of any adverse fluctuation.
Deposits
A per-person non refundable deposit of $750AUD or $500USD is required within 7 days (unless otherwise stated) of us accepting your booking. This deposit covers services such as processing, confirming, and preparing your travel arrangements. If we do not receive your deposit within the stated timeframe, your booking may be released. Rebooking will be subject to current pricing and availability.
Final Payment
Full payment must be received by the date shown on your invoice, or no later than 90 days before departure.
Payment Failure
If payment is not received by the due date, we will send a reminder. If payment is still not made within 7 days of the reminder, your booking will be deemed cancelled and cancellation fees will apply (see “Cancellations by You” below). You will also be liable for any costs incurred by Adventure Proud due to late payment.
CANCELLATIONS BY YOU
You may cancel your booking by providing written notice. Refunds will be processed minus cancellation fees, calculated from the date we receive written notice:
For any pre/post-tour accommodation, extensions, or third-party arrangements cancelled before commencement, the following apply:
Refunds from third parties will only be issued once Adventure Proud has successfully recovered funds, minus the above fees. We cannot guarantee recovery of third-party payments.
General cancellation terms
Cancellation fees will not exceed the total payments received. Any surplus after applying cancellation fees will be refunded. These fees are a genuine pre-estimate of our loss due to your cancellation. Travel insurance that covers cancellation is strongly recommended.
A request to transfer a booking to another departure date is considered a cancellation of the original booking.
OTHER CANCELLATIONS (Force Majeure & Operational Reasons)
A “Force Majeure” event is one beyond our control that we could not reasonably prevent (e.g. natural disasters, severe weather, war, terrorism, pandemics, government restrictions, civil unrest).
Prior to travel: If we determine your travel cannot proceed due to Force Majeure, or you notify us up to 14 days before departure that you cannot reasonably travel due to government restrictions, we may reschedule or cancel your trip. If cancelled, we will either:
During travel: If arrangements are cancelled mid-trip due to Force Majeure, we will refund recoverable third-party costs for unused services.
If we cancel for reasons other than Force Majeure or failure to meet minimum group numbers, you will be offered either a full refund or alternative arrangements of comparable value.
MINIMUM NUMBERS
All small-group tours are subject to minimum passenger numbers. If minimum numbers are not met, we may cancel or re-cost the trip up to 90 days before departure. If re-costed, you may accept the new price or cancel for a refund/credit.
Tours listed as “Guaranteed” will operate regardless of numbers, unless cancelled for exceptional operational reasons. In such cases, you will be offered a transfer to a new date at no extra cost, or a full refund.
AMENDMENTS
HEALTH, FITNESS & INSURANCE
Adventure Proud tours often involve active experiences. Travellers should have a good level of mobility and be able to walk for several hours daily, manage stairs and uneven ground, and handle varied climates.
Within 7 days of booking, you must submit a Passenger Registration Form and Fitness to Travel Declaration. Failure to do so may affect ticketing or booking confirmation.
Travel insurance with medical evacuation/repatriation cover is compulsory for all travellers. Proof of insurance may be requested prior to departure.
DURING TRAVEL
ACCEPTANCE OF RISK
Travel carries inherent risks. By booking, you acknowledge these risks, accept responsibility for your choices, and release Adventure Proud from liability to the extent permitted by law.
RESPONSIBILITY & LIABILITY
We act as a coordinator with independent suppliers (e.g., airlines, hotels, transport companies). While we select reputable partners, Adventure Proud is not liable for acts or omissions of independent suppliers outside our control.
To the fullest extent permitted by law, our liability is limited to re-supplying services or refunding the cost of services not provided.
COMPLAINTS
If you experience a problem, please notify our representative or supplier immediately so it can be resolved. If not resolved, submit a written complaint within 30 days of returning home.
IMAGE RELEASE
Adventure Proud may take photographs or recordings of your trip. By booking, you consent to their use for promotional purposes unless you notify us in writing at least 21 days before departure.
GENERAL
These Booking Conditions are governed by the laws of New South Wales, Australia. Any disputes will be handled by the courts of that jurisdiction.
If any provision is deemed unenforceable, the remainder will still apply. Bookings cannot be transferred without our written consent. Personal information will be handled according to our Privacy Policy and the Australian Privacy Principles.
